Minutes 06/09/2009 & 06/16/2009

The Morris County Commissioners met on Tuesday, June 9, 2009, at 9:00 a.m.; all members present.

 

Commissioner Revere moved to go into executive session at 9:10 a.m. for 15 minutes

for attorney/client privilege with Bill Kassebaum, county counselor, present.   Commissioner Hay seconded the motion.  Motion carried.  Regular session resumed at 9:25 a.m.  The county counselor was authorized (Revere, Jost) to request a judicial review of a Court of Tax Appeals decision of the Lipson property valuation case.  The motion carried two to one.  Commissioner Hay voted against the motion.

 

Sharon Pittman, county appraiser, gave a department report.  Pittman’s current term as county appraiser will expire on June 30, and a resolution will be drafted to appoint her to another four year term. 

 

Mark Schmidt, district conservationist of Dickinson County, and Tim Biehler, board member of Lyons Creek Watershed No. 41, discussed a proposed watershed project located in 7-15-5

that may inundate a portion of J Ave.  The county road supervisor will look at the area and meet with watershed officials to discuss the project.  Costs related to the project such as raising the road and extending or replacing culverts will be the responsibility of the watershed district.

 

Robert Mark, Jr. discussed right-of-way requirements for the Rock Creek Bridge project (64 C-4570-01).   Action was taken (Revere, Hay) to purchase .545 acre for $816 from Mr. Mark who owns land adjacent to the project site.  A deed was executed for the sale.  Motion carried.  Mark donated a temporary easement to the county for the duration of the project. 

 

The June 2nd meeting minutes were approved (Hay, Revere) as presented

 

John Lee gave reports for the solid waste and noxious weed departments. 

 

Ben Barr expressed appreciation for road work done in the Diamond Springs area.

 

Jeff Blosser, road superintendent, gave the weekly road report.  It was determined that 400 Rd between L & M Ave has been vacated.  A landowner in the area had requested that the county do some work on it. 

 

Authorization was given (Revere, Hay) for the road department to purchase computer equipment from Great Plains Computers for $3,345.  Motion carried.

 

The road superintendent was authorized (Revere, Hay) to submit an application to the state for a permit to excavate creek gravel in a couple of areas of the county.   Motion carried.  

 

Other work in progress by the highway department include the following:

            __F Ave from 1100 Rd to 1400 Rd was graveled

            __a low water crossing at Q Ave & 3000 Rd was repaired

            __various road rights-of-way were mowed

            __a purchase order numbering system was implemented

            __roads and ditches are being reviewed to determine the areas needing attention

 

An agreement was executed with KDOT (Hay, Revere) on the Rock Creek Bridge project

(64 C-4570-01).  Motion carried.  The county will receive 100% funding from federal stimulus monies for the project construction costs.  The county is responsible for design and engineering expense.

 

A request for FY09 funding of $500 for the Armory’s Station Fund was denied (Revere, Hay) due to failure to submit a timely budget request.  Motion carried.

           

Michael Powers, District Court Judge, Cecil Aska, county administrator, Geneva Mason, district court clerk, and Audie Magana, court trustee, presented 2010 budgets for offices in the 8th Judicial District.

 

The local district court office proposal is $38,152, down $3,273 from the 2009 budget due to an anticipated reduction of computer services and district expense.   Morris County’s share of the 8th Judicial District Budget will be $6,421 next year.   The court trustee’s budget does not require county tax monies.

The Morris County Commissioners met in regular session on Tuesday, June 16, 2009, at 9:00 a.m.; all members present.

 

Ray Ellerman and Delbert Johnson requested that 2200 Rd south of V Ave be graveled and maintained.  Currently the road is designated as a minimum maintenance road.  The road engineer will look at the area in question.

 

Trudy Hutchinson, Executive Director of Hetlinger Developmental Services, Inc., presented a report of the agency, and requested a county appropriation of $12,000 for 2010, the same as 2009.   Hetlinger staff personnel Sara Pearson and Jan Plunkett also attended the meeting.  The request will be considered when the county budget is prepared in a few weeks.

 

The Morris County Extension Council presented its 2010 budget for consideration.  The budget calls for a 2010 county appropriation of $103,348, an increase of $706 over 2009.   No decision was made pending further review.  Attending the meeting included Dale Fjell, K-State Extension field representative, Laura Marks, extension director, Jimmy Lerner, Jack Railsback, Marie Blythe, Bob Collins, and Jason Loomis.

 

John Lee gave the weekly Solid Waste and Noxious Weed department reports.   There are several areas in the county needing attention due to noxious weed infestation.   Roundup chemical in 2 ½ gallon containers is available for purchase at the Noxious Weed Department for $23.10 per gallon. 

 

It was noted that asbestos cannot be accepted at the transfer station due to KDHE regulations.  When buildings are torn down, care must be taken so that asbestos materials are not mixed in with the other demolition materials.  The transfer station will be closed on Saturday, June 19th due to the Wah-Shun-Gah days celebration.  

 

Members of the Morris County Soil Conservation District met with commissioners to present the agency’s 2010 budget proposal.  A PowerPoint presentation outlined the past year’s services and activities.  The group requested a county appropriation of $25,000, an increase of $6,000 over this year.  Commissioners will consider the request when the county’s budget is prepared.  Attending the meeting included Jim Henry, Joe Hecht, Jo Bea Titus-Hutchinson, Katie Miller, Jim Parker, Chris McAfee, Kent Bacon and Steve Euler.

 

Modifications were approved on an agreement with KDOT on the Rock Creek Bridge project (64 C-4570-01). 

 

Jeff Blosser, road engineer, gave the weekly report of the highway department.  County roads are being assessed to determine damage caused by heavy rains on June 15th.  County crews have been cutting and clearing trees that were blown down by heavy winds. 

 

A permit was granted (Revere, Hay) to Ross Olson to lay a water line along a county road located at 1050 Rd and J Ave in 9-15-8.   Motion carried.

 

A utility permit was approved (Hay, Revere) for Tri-County Telephone Assn. to lay fiber optic cable subject to additional conditions and requirements as outline in an addendum to the permit.  The permit covers work zones located in the southeast part of the county.  Motion carried.

 

The county filed for an extension of its permit to excavate natural stone from a site in the Four Mile area.
